Prenup / Antenuptial & Postnuptial Contracts
Commonly referred to as “prenups“, many do not think of marriage agreements as an estate planning tool.
These important contracts, working in conjunction with the rest of an individual’s estate plan, can help even those who are not just planning for a second marriage while having adult children. Specifying separate and joint property of each spouse, dealing with retirement assets and waivers, and determining income tax returns and gifts between spouses are all considerations when preparing these documents.
Each party to a marriage agreement should have his or her own independent attorney and be prepared to complete a financial disclosure listing assets and debts to successfully implement a premarital or postnuptial agreement.
